Terms & Conditions

Please read these Terms and Conditions carefully before using our Service.

These Terms and Conditions ("Terms") apply to the use of the service at www.weview.com.au and any inspection booking services and associated products ordered through it ("Service") operated by WeView (ABN 66 280 707 506). ("us", "we", or "our").

Your access to and use of the Service is conditional on your acceptance of and compliance with these Terms, which apply to all visitors, users and others who access or use the Service. You warrant that you are at least 18 years old and you are legally capable of entering into binding contracts.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you should not access the Service.

PURCHASES

Once your booking is confirmed, you agree to pay the booking fee prior to commencement of the service. If for any reason your assigned Viewer is not able to attend, we will replace them with another Viewer. If in the rare case we have no Viewers available to attend the property inspection, you will be immediately issued a refund.

DISCLAIMER OF SERVICE QUALITY

You acknowledge and agree that you use the Service at your own risk.

As a consumer, you have certain rights, such as the consumer guarantees under the Competition and Consumer Act 2010, which cannot by law be excluded (Non-Excludable Condition). This clause is subject to those Non-Excludable Conditions.

You agree that all implied guarantees, conditions and warranties that may otherwise be implied are excluded from these Terms, except any Non-Excludable Conditions.

Subject to the application of any applicable Non-Excludable Condition, all other liability to you for any costs, expenses, losses and damages suffered or incurred directly or indirectly by you in connection with these Terms or the Service, whether that liability arises in contract, tort (including by our negligence) or under statute, is excluded.

Subject to the application of any Non-Excludable Condition, we will not, under any circumstances, be liable to you for any Consequential Loss. Consequential Loss means loss of revenue, loss of profits, loss of anticipated savings or business, pure economic loss, loss of data, loss of value of equipment (other than the cost of repair), loss of opportunity or expectation loss and any other form of consequential, special, indirect, punitive or exemplary loss or damages.

To the extent permitted by law, our liability for breach of any Non-Excludable Condition is restricted to the re-supply of the Service subject of the Licence or payment of the cost of re-supply of the Service subject of the Licence.

AVAILABILITY, ERRORS AND INACURACY

You acknowledge and agree that you use the Service at your own risk.

-You agree that you are given the opportunity to request specific areas of a property to be inspected and focused on.

-You agree that there is a chance a Viewer may not be available at your chosen location, date and time

-You agree that viewing a property via digitalised technology such as a smart phone may result in errors/inaccuracies from what you see yourself in person.

-You agree that in some circumstances, video footage may not be available due to tenancy privacy reasons (at the discretion of the tenant/leasing agent). If this is the case, you will be provided with a basic report of the property condition (or) can speak with your Viewer over the phone directly throughout the inspection.

If serious errors have occurred with our service i.e.

Viewer did not turn up,

Viewer did not call at requested time,

Video quality too blurry to see,

Viewer missed areas you specifically requested to be focused on,

You are welcome to send us an email at hello@weview.com.au and we will address your case. If we agree that the service was not performed to our strict standards, you will be immediately issued a refund and credited to use a different local Viewer.
